Service Terms

These terms govern the AI receptionist and related services provided by Alexander Petro, doing business as Petro Applied Intelligence ("we," "us"), to the business that purchases them ("you"). You accept them when you tick the box at checkout.
1. What we provide
We configure and operate an AI phone assistant for your business. It answers calls, answers questions from information you give us, and books appointments onto your calendar. It can transfer a caller to a phone number you nominate. The plan and price are the ones shown at checkout.
We do not provide the telephone service itself. Your number stays with your carrier and under your control, and you can stop routing calls to us at any time without our help.
2. What we guarantee, and what we don't
While the service is running, your assistant answers every call that reaches it. The exceptions are the outages and failures described in section 6: those of the providers the service runs on, and of your own phone service, call forwarding, or internet.
We do not guarantee any number of appointments booked, customers won, or revenue earned. Those depend on your market, your pricing, your capacity, and how your team handles what we send you. Any figures we have shown you are illustrative and are not a promise of performance.
3. What you are responsible for
- Giving us accurate information about your services, prices, hours, and policies, and telling us promptly when any of it changes. The assistant repeats what you give us; if that information is out of date, it will say the out-of-date thing.
- Keeping your calendar current and reachable.
- Maintaining your own phone service and call routing.
- Your own compliance obligations as the operator of your phone line, including any notice you choose to give callers.
4. Fees, term, and cancellation
Service is billed monthly in advance and renews automatically until cancelled. You may cancel at any time by telling us in writing; service continues to the end of the period you have paid for. If you are unhappy, tell us and we will refund the current month — one month, not the history.
We may change pricing with 30 days' notice. If you do not accept the change, cancel before it takes effect.
On cancellation you remove the call routing to us, and we shut down your assistant. We will give you a copy of your call and contact data if you ask for it within 30 days, after which we may delete it.
5. Your data
Your contacts, call records, transcripts, and appointment data are yours. We hold and process them only to run the service for you and only on your instructions. We do not sell them and we do not share them with anyone except the vendors we use to deliver the service.
We create written transcripts of calls. We do not record or retain call audio.
We may use de-identified, aggregated information — nothing that identifies you, your business, or any caller — to improve how the service works.
We keep information about your business and your customers confidential.
6. Availability
The service runs on third-party platforms — telephony carriers, voice and language model providers, cloud hosting, and your CRM. We do not guarantee uninterrupted or error-free service, and we are not responsible for outages, delays, or failures caused by those providers or by your own phone service or internet.
The assistant is software and will sometimes be wrong. It may mishear a caller or fail to answer a question. Treat it as a capable receptionist rather than an infallible one, and tell us when it gets something wrong so we can correct it.
7. Ownership
We own the assistant configuration, prompts, templates, integrations, and software we build and operate, including anything we develop while serving you. You get the use of it for as long as you are a customer, not ownership of it.
You own your business content, your customer data, and anything you supply to us.
8. Limits on our liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE FEES YOU PAID US IN THE ONE (1) MONTH BEFORE THE EVENT GIVING RISE TO THE CLAIM.
WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST BUSINESS, OR MISSED OPPORTUNITIES, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
EXCEPT FOR THE COMMITMENT IN SECTION 2, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
You will indemnify us against any claim, loss, or expense, including reasonable attorneys' fees, brought by a third party and arising from your use of the service or the information you gave us.
These limits are a basic part of the deal between us and are why the price is what it is.
9. General
Either of us may end this agreement if the other materially breaches it and does not fix the breach within 15 days of being told about it. We may suspend the service immediately for non-payment.
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in El Dorado County, California.
We may update these terms with 30 days' notice to you. If a provision is unenforceable, the rest stays in force. You may not transfer this agreement without our written consent. These terms, plus what is shown at checkout, are the entire agreement between us about the service and replace anything said beforehand.
